1. Agreement to these Terms
These Terms of Use govern your access to and use of ABSCARSMARKET, including its auction, marketplace, account, messaging, offer, payment-authorization, and vehicle-submission features. By creating an account, submitting a vehicle, placing a bid or offer, or otherwise using the platform, you agree to these Terms and to any additional agreement presented for the relevant transaction.
2. Platform operator and role
ABSCARSMARKET is operated by ABS MARKETING LLC, a Florida limited liability company. Unless a listing expressly states otherwise, ABS MARKETING LLC provides an online marketplace and transaction-support service and is not the owner, seller, buyer, manufacturer, carrier, insurer, inspection company, escrow agent, or guarantor of a listed vehicle.
The purchase agreement for a vehicle is ordinarily formed directly between the seller and the winning buyer. We may facilitate communications, payment authorization, documentation, shipping introductions, and post-auction support, but we do not guarantee that either party will complete a transaction.
3. Eligibility and accounts
You must be at least 18 years old and legally able to enter binding contracts. Account information must be complete, current, and accurate. You are responsible for all activity conducted through your account and must protect your login credentials. We may request identity, payment-card, ownership, or other verification before allowing access to particular features.
4. Listings and vehicle information
Vehicle information may be supplied by sellers, owners, agents, third-party sources, inspections, or public records. Mileage, condition, history, originality, specifications, title status, import eligibility, and other statements may contain errors or omissions. Photographs and videos may not reveal every defect. Buyers must independently review the listing, ask questions, inspect the vehicle when appropriate, and verify all information material to their decision.
5. Auctions, bids, and offers
Bids and accepted offers are intended to create binding purchase commitments. Do not bid or submit an offer unless you have the authority and financial ability to complete the purchase. Auctions may be subject to a reserve. A no-reserve auction is intended to sell to the highest qualified bidder. ABSCARSMARKET may reject, cancel, or correct bids affected by fraud, technical error, manipulation, duplicate accounts, or violation of these Terms.
When a bid is received near closing, the auction may be extended under the soft-close rules displayed on the platform. The platform clock and server records control in the event of a difference between a user's device and the platform.
6. Buyer premium and payment authorization
The buyer premium is 5% of the winning bid or accepted price, subject to a minimum fee of USD 500 and a maximum fee of USD 7,500, unless a listing or written agreement clearly states otherwise. A payment card may be pre-authorized for the applicable buyer premium. A pre-authorization is not the vehicle purchase payment and may be captured or otherwise collected after a successful transaction or buyer default, as permitted by the applicable agreement.
7. Vehicle payment and completion
Unless the parties agree otherwise in writing, the buyer must contact the seller promptly and send cleared funds for the vehicle within three business days after the auction or accepted offer. Vehicle funds are ordinarily paid directly to the seller by bank wire. The vehicle should remain with the seller until cleared funds are confirmed. ABSCARSMARKET does not hold vehicle purchase funds as escrow unless expressly agreed in a separate written instrument.
8. Taxes, shipping, export, and registration
The buyer is responsible for shipping, insurance, customs, duties, taxes, import eligibility, emissions or safety compliance, registration, and all other costs after purchase unless a written agreement states otherwise. Shipping or import assistance is coordination only; third-party carriers, brokers, inspectors, payment processors, and government agencies remain responsible for their own services.
9. Prohibited conduct
You may not manipulate bidding, use multiple accounts, submit false information, interfere with platform operation, scrape or republish protected content without permission, evade fees, contact another user to circumvent an active transaction, upload malicious code, or use the platform for unlawful, fraudulent, or abusive purposes.
10. Suspension and removal
We may suspend accounts, remove content, cancel or pause a listing, restrict bidding, or preserve records when reasonably necessary to protect users, investigate suspected misconduct, comply with law, correct an error, or maintain platform integrity.
11. Intellectual property
The platform design, branding, software, editorial material, and original content are owned by or licensed to ABS MARKETING LLC. Sellers grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, edit for presentation, distribute, and promote submitted listing content for operating and marketing the platform.
12. Disclaimers
The platform is provided on an “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted operation. We do not warrant a vehicle, seller, buyer, bid, offer, inspection, transport service, title document, or transaction outcome.
13. Limitation of liability
To the maximum extent permitted by law, ABS MARKETING LLC and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profit, loss of opportunity, loss of data, vehicle damage, transportation loss, or a party's failure to complete a transaction. Our aggregate liability arising from a transaction will not exceed the platform fee actually paid to us for that transaction, except where applicable law does not permit that limitation.
14. Indemnification
You agree to indemnify and hold harmless ABS MARKETING LLC and its personnel from claims, losses, costs, and reasonable legal fees arising from your content, your vehicle, your breach of an agreement, your violation of law, or your infringement of another person's rights.
15. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to the platform will be brought in the state or federal courts serving Broward County, Florida, and each party consents to that jurisdiction and venue.
16. Electronic records and communications
You consent to transact electronically and to receive agreements, notices, disclosures, and transaction communications electronically. Your clicks, checkbox acceptance, bids, offers, and other electronic actions may be retained as evidence of your agreement.
17. Changes and contact
We may update these Terms prospectively by posting a revised effective date. Material changes may also be communicated through the platform or by email. Questions may be sent to info@abscarsmarket.com.
