Seller Agreement

1. Authority to sell

You represent that you own the vehicle or have documented authority from the owner to sell it, that the vehicle is not subject to undisclosed liens or claims, and that you can provide the documents reasonably required to transfer ownership.

2. Accurate disclosure

You must provide complete and accurate information about identity, ownership, location, mileage, title or registration status, accident or damage history, mechanical condition, modifications, restoration, known defects, liens, and any fact material to a buyer. You must promptly correct information that becomes inaccurate.

3. Photographs, video, and documents

You agree to provide the media and documentation reasonably requested for an accurate listing, which may include at least 80 current photographs, walkaround and driving videos, a cold-start video, VIN or chassis markings, engine bay, underbody, labels, records, and ownership documents. You grant ABS MARKETING LLC permission to edit for presentation, publish, distribute, and promote those materials in connection with the listing and platform.

4. Exclusivity and listing period

Unless agreed otherwise in writing, an accepted vehicle must not be advertised, auctioned, or offered through another public platform during the ABSCARSMARKET auction. The normal auction duration is approximately 10 days. You must disclose existing advertisements and remove conflicting listings before publication.

5. Reserve and auction result

Any reserve must be approved in writing before the auction begins. If the reserve is met, or if the vehicle is offered with no reserve, you agree to sell to the highest qualified bidder. You may not bid on your own vehicle, direct another person to bid on it, or otherwise manipulate the result.

6. Seller fees and proceeds

There is no seller fee unless a separate written agreement states otherwise. The buyer premium is charged separately to the buyer. The seller receives the agreed vehicle purchase price directly from the buyer, subject only to separately agreed expenses or services.

7. Vehicle custody and payment

The vehicle remains in your possession until cleared funds are received. Do not release the vehicle, title, keys, or original ownership documents based solely on a payment screenshot or unverified email. You must cooperate promptly with the buyer on payment verification, bill of sale, title transfer, collection, and shipping arrangements.

8. Post-auction transactions

If a reserve is not met, ABSCARSMARKET may facilitate post-auction offers or move the vehicle to the Marketplace. A sale to a buyer introduced through the platform remains subject to the applicable buyer premium and platform agreements, even if completed after the auction.

9. Withdrawal and seller default

You may not withdraw an accepted listing after publication, sell around the platform, refuse to complete a reserve-met sale, or materially change the vehicle without written approval. If you breach this Agreement, we may remove the listing, suspend your account, disclose the cancellation to affected users, and seek reimbursement for documented costs or losses to the extent permitted by law.

10. Seller warranties and indemnity

You remain legally responsible for your representations, the vehicle, ownership, liens, and transfer documents. You agree to indemnify ABS MARKETING LLC from claims and losses arising from inaccurate disclosure, lack of authority, undisclosed liens, your breach, or your violation of law.

11. Incorporated terms

The Terms of Use and Privacy Policy are incorporated into this Seller Agreement. Vehicle-specific written terms accepted by both parties control over inconsistent general provisions.
