Buyer Agreement

1. Buyer commitment

By placing a bid, using Buy Now, or submitting an offer that is accepted, you confirm that you are at least 18 years old, have authority to act, and have the funds necessary to complete the transaction. A winning bid or accepted offer is a binding commitment, subject to the listing terms and applicable law.

2. Independent due diligence

You are responsible for reviewing the complete listing, photographs, videos, documents, comments, seller responses, and disclosed defects. You should ask questions and arrange a pre-purchase inspection when necessary. Statements about mileage, originality, service history, accident history, title, registration, specification, condition, or import eligibility must be independently verified.

3. Vehicle condition

Unless the seller expressly provides a written warranty, vehicles are offered “as is, where is,” with all faults and without warranties by ABS MARKETING LLC. Age, use, storage, modifications, restoration work, and transport can affect condition. Normal wear and undiscovered defects do not cancel a buyer's payment obligation.

4. Bidding and auction close

You may not retract a bid merely because you changed your mind, misunderstood shipping costs, failed to inspect the vehicle, or did not secure financing. The platform may use proxy bidding and soft-close extensions. Server records control the winning bid, time, and account identity.

5. Buyer premium

The buyer premium is 5% of the winning bid or accepted price, with a USD 500 minimum and USD 7,500 maximum, unless a listing clearly states different terms. You authorize the payment-card pre-authorization and collection procedures presented during bidding. The buyer premium is separate from the vehicle purchase price, taxes, shipping, customs, and registration costs.

6. Payment to seller

After a successful auction or accepted offer, you must respond promptly and pay the seller the full vehicle price in cleared funds within three business days, unless the seller agrees otherwise in writing. Verify all wire instructions through a trusted communication channel before sending funds. ABS MARKETING LLC does not receive the vehicle purchase price or act as escrow unless confirmed in a separate written agreement.

7. Title, taxes, shipping, and import

You are responsible for confirming the documents needed to transfer ownership and for all sales, use, value-added, import, customs, registration, emissions, safety, and similar requirements. You are also responsible for collection, inland transportation, marine or air freight, cargo insurance, storage, and delivery unless otherwise agreed in writing.

8. Buyer default

If you fail to complete a binding purchase, we may suspend your account, notify the seller, preserve transaction records, retain or collect the applicable buyer premium to the extent permitted by the authorization and law, and recover reasonable losses or costs. The seller may also have independent legal remedies.

9. Platform role

ABS MARKETING LLC facilitates the transaction but is not the seller and does not guarantee the vehicle, documents, ownership transfer, seller performance, transport, or registration. Any dispute concerning the vehicle purchase should first be addressed directly between buyer and seller.

10. Incorporated terms

The Terms of Use and Privacy Policy are incorporated into this Buyer Agreement. If a listing contains specific written terms that conflict with a general provision, the specific listing terms apply to that transaction.
